Comuniq-Chat Terms of Use

Version 2026-10-28

By signing up for Comuniq-Chat you accept our Privacy Policy and agree not to:

1. Service provider

[FULL NAME OR COMPANY NAME] (Theia Island) · [TAX ID] · comuniq@theiaisland.com.

2. The service

Comuniq-Chat lets you send end-to-end encrypted messages and files between phones connected to the same Wi-Fi network (the "comuniq" network), without Internet except for registration and account deletion. Delivery depends on both devices being switched on, with the app running and within range of the network. The service is free and provided "as is".

3. Account

4. Content and encryption

You are solely responsible for the content you send. By design, we have no access to your messages or files, which do not pass through our servers; we cannot recover or moderate them. You can verify the encryption of each conversation by comparing the security code with your contact.

5. Reports and point of contact (DSA)

If you receive illegal content or a user breaches these terms, report it to comuniq@theiaisland.com stating their username and the facts. This is also the single point of contact for authorities and recipients of the service under Arts. 11 and 12 of the Digital Services Act, Regulation (EU) 2022/2065 (languages: Spanish and English). We may suspend or delete accounts that breach these terms or the law, giving reasons and informing the affected user of how to appeal.

6. Deleting your account

You can delete your account at any time from the app (menu ⋮ → "Delete my account").

7. Liability

To the extent permitted by law, we are not liable for messages that cannot be delivered, network or device failures, or how users use the service. Nothing in these terms limits your rights under consumer protection law.

8. Changes

If we materially change these terms, we will let you know in the app and, where necessary, ask you to accept them again.

9. Governing law

These terms are governed by Spanish law. If you are a consumer, you keep the protection of the mandatory rules of your country of residence and may bring proceedings before the courts of your domicile.
